Undisclosed Social Media Influencer Advertising – Class Action Investigation

Chimicles Schwartz Kriner & Donaldson-Smith LLP (CSKD) is investigating potential class action claims on behalf of consumers who purchased goods or services based on undisclosed advertising by social media influencers. Social media influencers often make posts advertising products on social media platforms such as Instagram, TikTok, and X (formerly Twitter). Pursuant to FTC guidelines, however, when a social media influencer makes a post advertising a product, the influencer is required to disclose any affiliation or partnerships with, or any compensation from, companies in exchange for advertising the companies’ products. When social media influencers fail to disclose these paid relationships, the advertising is deceptive, misleading, and unfair to consumers and may result in the customer paying more for the product than she should have.
