Chimicles Schwartz Kriner & Donaldson‑Smith files class action against Costco regarding rotisserie and Kirkland Signature raw chicken
Chimicles Schwartz Kriner & Donaldson‑Smith LLP filed a class action complaint in the United States District Court for the Western District of Washington on February 12, 2026, asserting claims on behalf of Costco customers who purchased Costco’s $4.99 rotisserie chicken and its Kirkland Signature brand raw chicken products.
The Complaint alleges that Costco misled consumers about quality and safety of its chicken by failing to address persistent Salmonella contamination at its Lincoln Premium Poultry plant built specifically to oversee production ‘from hatchery to shelf.’ According to USDA inspection records, the plant has repeatedly received a category three rating — the lowest food safety designation — in 92% of reporting periods since opening in 2019. Yet Costco’s marketing and labeling did not disclose these risks to consumers.
The Complaint brings claims for deceiving customers under the Washington Consumer Protection Act and for unjust enrichment and breach of the implied warranty of merchantability.
