CSK&D Files Class Action Complaint Against Subaru Related to Alleged Battery Drain Problems
On March 25, 2020, Chimicles Schwartz Kriner & Donaldson-Smith filed a class action complaint in the United States District Court for the District of New Jersey related to alleged battery drain problems in in 2016-2020 Subaru Outback and 2019-2020 Subaru Ascent vehicles (“Class Vehicles”). The Complaint, filed on behalf of a putative class of consumers who have owned or leased one of the Class Vehicles, alleges that Class Vehicles contain a defect that results in repeated battery drain and failure. Because of the alleged defect, drivers often find their cars inoperable and unable to start. The Complaint brings claims alleging breaches of warranty and consumer fraud.
