CBD Products – Class Action Investigation
Chimicles Schwartz Kriner & Donaldson-Smith (CSK&D) is investigating potential class action claims against manufacturers of products containing cannabidiol (“CBD”) that market CBD products as dietary supplements, including oils, drops, and gummies. The Food and Drug Administration (“FDA”) has recently determined that CBD is a “drug” and, therefore, adding it to food or marketing it as a dietary supplement is illegal. Accordingly, many CBD products are allegedly being sold illegally and are allegedly being marketed and labeled with false or deceptive statements. Selling unapproved products with unsubstantiated therapeutic claims is not only a violation of the law, but also can put patients at risk, as these products have not been proven to be safe or effective.
