Philips Recalled CPAP Products Liability Litigation

Chimicles Schwartz Kriner & Donaldson-Smith filed a class action complaint in the United States District Court for Western District of Pennsylvania related to a recall of over ten million Philips brand DreamStation CPAP and BiPAP machines which are used to treat sleep apnea as well as certain ventilators. Philips recalled the devices because the PE-PUR foam that is used in the machines to dampen the sound can degrade over time and form dangerous black particles and volatile organic gases that can get into the patient’s airways. This can result in a number of serious health conditions and is a potential carcinogen. CKSD serves as Plaintiffs’ Co-Lead Counsel. The parties reached a proposed settlement of the economic loss claims that requires the Philips Defendants to pay a minimum of $479 million to consumers and third party payors who paid or reimbursed for the purchase of the recalled devices.
