CSK&D Files Consolidated Amended Complaint in Wawa Data Breach Class Action

On June 12, 2020, the United States District Court for the Eastern District of Pennsylvania issued an order which appointed CSK&DS Partner Ben Johns, along with three other attorneys, as Interim Co-Lead Class Counsel for the putative class of Consumer Plaintiffs in the Wawa data breach class action. The case relates to a nine-month long data breach which was first publicly announced on December 19, 2019, and which affects all of Wawa’s convenience stores and gas pump locations. The District Court has also ordered that the Consumer Plaintiffs file a Consolidated Amended Complaint by July 27.

Updated: On July 27, 2020, Consumer Plaintiffs filed their Consolidated Amended Complaint. The Complaint includes thirteen Plaintiffs who assert claims on behalf of a nationwide class and state subclasses comprised of all persons in the United States who used a credit or debt card at a Wawa location impacted by the Data Breach at any time during the Data Breach period. Plaintiffs assert claims against Wawa for negligence, negligence per se, breach of implied contract, unjust enrichment, and violation of various state consumer protection statutes in connection with the Data Breach.
