Carter’s Inc. Children’s Clothing Store False Discounts  – Class Action Investigation

Chimicles Schwartz Kriner & Donaldson-Smith is investigating a potential class action lawsuit against Carter’s children’s clothing company for allegedly advertising false price discounts for its infant and young children’s apparel sold throughout its stores and on its website.

Specifically, it has been reported that Carter’s fabricates a false “original” price for its products and then offers those products at a substantially lower price under the guise of a discount.  This tactic, known as false reference pricing, misleads consumers into believing they are getting a bargain, when they are just paying full price for these items. Carter’s shoppers thus not only do not receive the promised discount, but also pay a premium for the clothing that it does not otherwise command.

For example, say a piece of clothing has a market price of $5.00. But that same piece of clothing is advertised for $100 and 90% off, for a false referencing price of $10.00. The shopper believes they have received a good deal but, in actuality, they have paid double what the piece of clothing is worth.
