Unlawful Civil Retail Theft Practices  – Class Action Investigation

Chimicles & Tikellis is investigating proposed class action lawsuits against certain retailers engaging practices and procedures relating to retail theft.  Specifically, C&T is investigating claims that retailers unlawfully detain individuals it suspects of retail theft and forces or coerces these individuals to sign retail theft confession forms.  Reports indicate that these practices occur despite the fact that a store patron or customer is innocent of theft.  These confession forms require individuals to confess to theft and to promise to pay penalties and fines that may not be supported by the law.

Many states have enacted a civil retail theft statute providing a channel or method for retailers to seek recovery and civil penalties for perpetrators of retail theft.  C&T is investigating whether certain retailer practices relating to retail theft unlawfully circumvent these statutes, arise to fraudulent practices, and result in confessions that are coerced, made under duress, or that result from false imprisonment.
