C&T is investigating a potential class action against Timber Treatment Technologies (TTT) relating to its TimberSIL wood product. TimberSIL is a glass-infused wood – an alternative to traditional wood – used for outdoor structures such as decks, steps, handrails, porches, and other structures. This product was widely used in rebuilding and construction efforts in New Orleans following Hurricane Katrina. Reports indicate that TimberSIL prematurely fails by rotting, despite TTT’s representations that the product is “an effective barrier in lumber to rot, decay and common wood problems.” Furthermore, a 2009 study by the Department of Wood Science Engineering at Oregon State University reportedly found that TimberSIL wood was “only slightly resistant to decay,” and therefore unsuitable for exterior exposure. Reports indicate that despite a 40 year warranty that accompanies the wood, the product prematurely rots and otherwise fails within a few months or years of installation. The result of these alleged failures and defects are costly replacements and other property damage to consumers property and structures.
