State Farm Insurance Overtime Pay Investigation

Chimicles & Tikellis is investigating a potential class action lawsuit on behalf of insurance investigators employed by State Farm Insurance.  It is alleged that State Farm purposefully misclassifies its insurance investigators as administrative employees to avoid paying them overtime in violation of the Fair Labor Standards Act.  The Fair Labor Standards Act requires employers to pay employees overtime pay for hours worked over 40 in a workweek at a rate of at least 1.5x their regulate rate of pay unless the employee is an “administrative employee.”  It is further alleged that State Farm insurance investigators do not meet the administrative employee exemption and thus are entitled to overtime pay.
