Chimicles & Tikellis is investigating a potential class action lawsuit against companies that record telephone conversations with their customers without disclosing that they do so. A law in California prohibits the recording of confidential communications made over the telephone without obtaining the consent of all parties. Another California law forbids the recording of all communications without the consent of all parties, where one of the parties is calling on a cordless or cellular phone. Companies that violate the statute can potentially be liable for damages of $5,000 per recorded communication.
