Pre-Employ Consumer Background Reports – Class Action Lawsuit

On October 16, 2013, Chimicles & Tikellis LLP filed a class action lawsuit in the District of Oregon against Pre-Employ.com, Inc. for alleged non-compliance with the requirements of the Fair Credit Reporting Act (“FCRA”).  FCRA requires that credit reporting agencies, such as Pre-Employ, to either furnish notice to a consumer who is the subject of one of its reports, or to establish and maintain strict procedures to ensure the content of its reports are accurate.  The class action lawsuit alleges that Pre-Employ does not provide consumers with advance notice when they are the subject of a consumer report and that Pre-Employ does not maintain strict procedures to ensure the contents of such reports are accurate.  It has alleged that Pre-Employ has provided inaccurate criminal histories in its reports in the past, which has led to consumers being improperly denied employment opportunities.
