Chimicles & Tikellis LLP is investigating a potential class action lawsuit on behalf of consumers who have purchased GlaxoSmithKline’s allergy relief drug Flonase since it was approved for over the counter sales in July of 2014. Another drug manufacturer recently sued GSK alleging that it had made affirmatively false and misleading statements in connection with its Flonase sales. Specifically, the lawsuit alleged that GSK stated that Flonase “OUTPERFORMS THE #1 ALLERGY PILL” – a claim purportedly based on purported head to trials with Claritin, which is not the best selling allergy pill. It was also alleged that there is no testing data showing that Flonase is superior to the best selling allergy pills on the market. Finally, it was also alleged that GSK falsely claimed that Flonase controlled 6 different allergy symptoms, while the other leading pills control only one. GSK agreed to settle these allegations a few weeks after the lawsuit was filed.
