OpenSea NFT Sales – Class Action Investigation

CSK&D is investigating a potential class action lawsuit against the popular NFT marketplace, OpenSea, based on reports that a security vulnerability can allow hackers to buy NFT’s at well below the market price. According to reports, a bug, which has been present for weeks, can be exploited by hackers to buy NFT’s at significantly lower prices, essentially forcing people to sell valuable NFT’s at prices they otherwise would not have accepted. Sellers can lose significant amounts of money. For example, a Bored Ape Yacht Club NFT was recently “sold” for six figures less than the market price. According to reports, OpenSea has not fixed the bug.
