On the Border Restaurant Chain Data Breach –Class Action Investigation
CSK&D is investigating a potential class action lawsuit on behalf of consumers affected by a recent data breach at a number of On the Border restaurant locations. On the Border is a tex-mex restaurant chain located in 27 different states. The data breach, which was implemented through the use of highly technical PoS malware, reportedly occurred between April 10, 2019 and August 10, 2019. As part of the breach, customer payment card information was exposed including names, card numbers, expiration dates, and verification codes. Only customers that used their credit and/or debit cards at the affected franchise locations potentially had their information exposed by this breach. Customers who used the company’s catering and delivery services were not affected. At this time, the company does not know precisely the exact locations affected by the breach, nor the estimated number of customers affected.
