On-Call Pay for Retail Employees – Class Action Investigation

Chimicles & Tikellis is investigating a potential class action lawsuit on behalf of employees of 13 companies that are required to work “on-call.”  On-call employees are typically required to be available to come in to work if the store is busy, and may not be required to show up at all if business is slow.  It has been alleged that the below companies are failing to pay on-call employees the minimum hours and wage for being on-call, contrary to state law.  The stores alleged to be in violation of the law are:

  • Abercrombie & Fitch
  • Ann Inc.
  • Burlington Stores
  • Crocs
  • C. Penny
  • J Crew
  • L Brands
  • Sears
  • TJX
  • Urban Outfitters
  • Williams-Sonoma
