Noom Membership Deceptive Billing Practices – Class Action Investigation

CSK&D is investigating a potential class action case related with Noom’s deceptive business practices. Noom is a popular health management mobile app that provides nutrition and exercise coaching. The Company allegedly engages in deceptive billing practices. When first signing up for the service, new users are prompted to fill-out a health evaluation to assist in finding the right plan for them. Noom will then offer a purported risk-free 14-day trial that can cost anywhere between $1-$10.

Right when the trial ends, or even before in some instances, new users have reported being charged anywhere between $120-$160 for a six month membership. Cancellation is not straightforward either, requiring members to send an email or message to customer service, who reportedly will not always respond in a prompt manner, or even at all, to confirm cancellation. Additionally, the Company will typically refuse to refund any paid amounts for the membership, asserting that their terms and conditions do not allow for any refund of paid costs. In some rare instances, some users have reported being fraudulently billed for a membership, even after cancelling their membership.
