C&T is investigating violations of the FCC’s rules regarding net neutrality for Internet service providers (ISPs). The rules require, among other things, that ISPs cannot block or throttle lawful content and ISPs must publicly disclose accurate information regarding the network management practices, performance, and commercial terms of its broadband Internet access services and ensure the ISP’s advertisements and marketing materials are accurate and not misleading. The FCC rules and Title II of the Communications Act give individuals a private right of action to seek relief against ISPs for violations of the net neutrality rules. As such, violations may be actionable under federal law.
