Kyles, et al. v. Stein Mart, Inc., et al., No. 1:19-cv-00483-CFC (D. Del.)

Chimicles Schwartz Kriner & Donaldson-Smith LLP (“CSK&D”) filed this class action lawsuit against Stein Mart, Inc. (“Stein Mart”) and Social Annex, Inc. (“Annex”) (together with Stein Mart, “Defendants”)—a company that provided a service to Stein Mart that enabled its consumers to use their username and password from other websites (such as Facebook and Amazon) to log in to Stein Mart’s online store and make purchases thereon—following Stein Mart’s announcement in November 2018 that Annex’s system was accessed by unauthorized users who were able to capture consumers’ (a) names; (b) addresses; (c) email addresses; and (d) credit/debit card numbers, expiration dates, and security codes (“CVV numbers”).

On May 10, 2019, both Defendants filed separate motions to dismiss Plaintiffs’ class action complaint. On June 7, 2019, Plaintiffs filed their opposition to both Defendants’ motion to dismiss, which can be accessed below:
