Chimicles & Tikellis is investigating a potential class action lawsuit on behalf of individuals who appeared on “Jerk.com” – a website containing profiles of individuals who are labeled a “jerk” or “not a jerk.” It has been alleged that, contrary to Jerk.com’s website representations that user profiles had been created by other Jerk.com users, most profiles were harvested from Facebook profiles or created by Jerk.com’s operator. Further, Jerk.com allegedly charged consumers $25 to email Jerk.com’s customer service department, and also falsely told consumers that if they paid $30 for a website subscription that they could dispute information posted on Jerk.com in addition to other benefits. According to the Federal Trade Commission, however, most consumers who paid Jerk.com to email customer service or paid Jerk.com a subscription fee received nothing in return.
