ITT Technical Institute WARN Act Violation – Class Action Investigation
C&T is investigating a potential class action against the for-profit technical institute ITT following reports that ITT announced it is closing its doors permanently on September 6, 2016 in violation of the Worker Adjustment and Retraining Notification Act (the “WARN Act”).
Specifically, ITT recently publicly announced that due to financial issues involving the United States Department of Education, it could no longer continue to operate and that, as part of closing down its operations, ITT would be laying off more than 8,000 employees. C&T is investigating whether ITT has provided the requisite 60-day notice of this mass layoff, as required under the WARN Act. A covered employer’s failure to provide the required 60-day notice of a mass layoff under the WARN Act can result in an employer being obligated to pay back pay and benefits for each day of the violation.
