C&T Litigating Class Action Lawsuit Related To Administration Fees Charged By Cigna and American Specialty Health Networks for Chiropractic Treatment

C&T and its co-counsel are litigating a class action lawsuit on behalf of Cigna insureds against Cigna and American Specialty Health Networks (“ASH”), alleging that Cigna and ASH charge an administrative fee on insureds’ in-network chiropractic services in violation of ERISA and the terms of Cigna insurance plans.

According to the amended complaint, Cigna, which serves as the claims administrator for the employer benefits plans it offers, delegates administration of chiropractic claims to ASH. However, Cigna does not pay ASH for its services. Instead, Cigna and ASH add an administrative fee to Cigna insureds’ chiropractic claims and charge patients and their plans for the services ASH provides to Cigna. Cigna and ASH do not disclose to Cigna insureds or their plans or their chiropractic providers that this fee has been added or charged.

This lawsuit is pending in the Eastern District of Pennsylvania at Carol A. Lietz v. Cigna Corporation, et al., No. 2:16-cv-03967-NIQA (E.D. Pa). A copy of the amended complaint can be viewed below.
