Chimicles Schwartz Kriner & Donaldson-Smith filed a class action complaint in the Middle District of Pennsylvania against Rutter’s, Inc., following the company’s announcement that the point-of-sale devices at its convenience stores and gas pumps were hacked between at least August 30, 2018 and May 29, 2019. The information compromised in this data breach included customers’ names, payment card numbers, card expiration dates, and CVV numbers.
According to the complaint, the data breach was the inevitable result of Rutter’s’ failure to adopt adequate data security measures. The complaint further alleges that Rutter’s has failed to provide meaningful assistance to consumers to help them deal with the fraud resulting from the data breach. Rather than offering monitoring services or fraud insurance, Rutter’s is only telling its customers to carefully monitor their own accounts and remain vigilant for fraud.
