College and University No-Poaching Agreements and Antitrust Violations-Class Action Investigations

CSK&D is investigating reports that competitor colleges and universities may be entering into “no-poach” agreements, in which a given university or college agrees not to hire employees of another college or university.  These types of no-poach agreements are anti-competitive and may be in violation of civil antitrust laws.  Indeed, the Department of Justice antitrust division has clamped down on this practice in recent years given the anticompetitive nature of the agreements.
