Chimicles & Tikellis is investigating a potential class action lawsuit on behalf of consumers related to allegations that Chobani made false statements in connection with the sale of its Simply 100® Greek Yogurt. Chobani claims that Simply 100® is the only 100-calorie Greek Yogurt “without a trace of any artificial sweeteners or artificial preservatives.”
One of Chobani’s competitors, Dannon, has recently alleged that Chobani made affirmatively false statements in ad campaigns related to Simply 100®. Specifically, it has been alleged in a lawsuit that Chobani’s advertisements have falsely claimed that Dannon’s competing yogurt contains a “bad” ingredient (sucralose); Dannon has added chlorine to its yogurt; and, for these reasons, consumers should purchase the Chobani brand instead of the Dannon brand. Dannon alleges that Chobani has affirmatively misrepresented the ingredients in both company’s yogurt products, and has claimed that the Chobani yogurt itself contains chlorine in the form of chlorides.
