On August 30, 2019, Chimicles Schwartz Kriner & Donaldson-Smith LLP, along with co-counsel, filed a Motion for Preliminary Approval of Class Action Settlement in a class action lawsuit against Subaru related to 2017-2018 Impreza, 2018 Outback, 2018 Legacy, 2018 Crosstrek, and 2018 BRZ vehicles. The Plaintiffs in this lawsuit allege that the “Starlink” infotainment systems in these vehicles are defective resulting in a wide-ranging technical and performance issues.
The proposed settlement class is comprised of all individuals in the United States who purchased or leased one of these vehicles. The proposed settlement provides benefits for the class estimated at over $6.25 million. This includes, among other benefits, an extended warranty covering the Starlink systems on all affected vehicles as well as the ability for class members to claim cash compensation of up to $300 if they had to have their infotatainment systems repaired multiple times and/or $16/day spent without a functioning system while replacement head units were on backorder. If approved by the Court, formal notice to settlement class members will be issued within 60 days from the date of the preliminary approval order. We will also post a link to the official settlement website, which will contain additional information about the lawsuit and settlement, once it is approved and has gone live.
The lawsuit is titled Udeen et, al. v. Subaru, Case No. 1:18-CV-17334-RBK-JS and is pending in the United States District Court for the District of New Jersey. The Court will schedule a hearing to determine whether to preliminarily approve the settlement. The motion for preliminary approval and the settlement agreement can be accessed below.
