Chimicles Schwartz Kriner & Donaldson-Smith LLP (CSK&D) Files Class Action Complaint Against Creation Entertainment, Related to Data Breach

CSK&D has filed a class action complaint in the Superior Court of the State of California, County of Los Angeles against Creation Entertainment, Inc., a company that produces  conventions for fans of genre television and movies, following Creation Entertainment’s announcement that the personal information—including credit/debit card numbers, expiration dates, and security codes (“CVV”)—of customers who made online purchases on its website for convention tickets and/or licensed products in and prior to October 2018, have been accessed by unauthorized users as part of a data breach.

According to the complaint, the data breach was the inevitable result of Creation Entertainment’s inadequate data security measures despite the ever-growing threat of security breaches involving payment card systems. Further, the company allegedly failed to provide meaningful assistance to consumers to help deal with the fraud that has and will continue to occur, and instead informed customers that its new system does not have any issues.
