Cheddar’s Scratch Kitchen – Data Breach-Class Action Investigation
Chimicles Schwartz Kriner & Donaldson-Smith (“CSK&D”) is investigating a potential class action lawsuit against Cheddar’s Scratch Kitchen (“Cheddar’s”)—a subsidiary of the American multi-brand restaurant conglomerate, Darden Restaurants, Inc. (“Darden”)—following Darden’s announcement that it has detected a cyberattack incident involving its restaurants in the following 23 states: Alabama, Arizona, Arkansas, Delaware, Florida, Illinois, Indiana, Iowa, Kansas, Louisiana, Maryland, Michigan, Missouri, Nebraska, New Mexico, North Carolina, Ohio, Oklahoma, Pennsylvania, South Carolina, Texas, Virginia and Wisconsin.
On August 22, 2018, Darden issued a press release that provided further information about the incident (available here: https://www.prnewswire.com/news-releases/notice-of-unauthorized-access-to-cheddars-scratch-kitchen-guest-data-300701161.html), in which it admitted that customers’ payment card information, including credit and debit card numbers, were compromised in the breach: “We believe that payment card information, including card numbers, from guests who visited the affected Cheddar’s restaurants between Nov. 3, 2017 and Jan. 2, 2018, may have been exposed.” Darden estimates that 567,000 payment card numbers were compromised.
