Capital One Assistant Branch Managers

Chimicles & Tikellis is investigating a potential collective action lawsuit against Capital One on behalf of Assistant Branch Managers (“ABMs”) to recover overtime compensation.  It has been reported that Capital One treats ABMs as being exempt from overtime compensation.  However, due to understaffing at the bank branches, ABMs actually spend the majority of their time performing the same sales and customer service duties as non-exempt, hourly tellers and personal bankers.  As a result, these ABMs may in fact be entitled to overtime compensation for hours worked over 40 in a work-week.
