Blu Products Cell Phone Spyware and Privacy Violations – Class Action Investigation
C&T is investigating a potential class action lawsuit against Florida-based wireless phone manufacturer Blu Products, Inc. amidst reports that that it installs spyware onto some of the cellular smartphones it designs and distributes throughout the United States. Blu Products has admitted that the spyware “collect[ed] unauthorized personal data in the form of text messages, call logs, and contacts from customers,” and this data has been sent to servers located in China. Blu Products installed the spyware – a derivative of software developed by Shanghai Adups Technology Company – on its phones without informing consumers.
Consumers can confirm whether their Blu Products phone is affected by the spyware by going to Settings Menu in Android, selecting “Apps,” selecting “Show System” and then “Wireless Update.” Phones with a version of Wireless Update from 5.0.x to 5.3.x, or above, are affected.
Blu Products’ installation of spyware on its mobile phones may be a violation of state and federal privacy laws as well as consumer protection statutes. If you believe your Blu Products phone is affected by the spyware, please contact the lawyers listed on this page.
