2021-2022 Subaru Outback Battery Drain – Class Action Investigation

CSK&D is investigating reports that 2021-2022 Subaru Outback vehicles experience random liftgate openings and other electrical issues which cause the batteries in these vehicles to rapidly drain.  This often occurs overnight or during intervals of non-use.  When the battery drain occurs, it leaves Outback owners and lessees without an operating vehicle. One report indicates that the batteries equipped in these vehicles may be underpowered to meet all of the electrical demands of certain recent Subaru models. Consumers report that when they complain to Subaru about this issue, the dealers refuse to replace batteries or to make an adequate repair.   Many consumers are told that the issue must be because they left their lights on, pressed the liftgate open button on their keyfob, or simply are not driving their vehicle frequently enough.  When Subaru does agree to replace a battery, owners and lessees often experience the same issue subsequent to the repair.

Consumers are incurring expenses associated with the dead battery, including towing costs, rideshare and taxi service fees, and other expenses.  Subaru’s failure to disclose and to remedy this issue may be a violation of consumer protection and warranty laws.
