2017 Chrysler Pacifica Stalling and Sudden Shut-Off – Class Action Investigation

2017 Chrysler Pacifica Stalling and Sudden Shut-Off – Class Action Investigation

Chimicles & Tikellis LLP is investigating a potential class action lawsuit against automaker Fiat Chrysler Automobiles N.V. (“Fiat Chrysler”) following reports that its 2017 model year minivan the Pacifica is susceptible to dangerous mid-drive stalling and shut-off.

Specifically, owners and lessees of model year 2017 Chrysler Pacifica minivans report that while driving – including on highways at speeds as high as 70 m.p.h. – brand-new Pacifica minivans, the automobiles will suddenly stall and shut off, causing rapid deceleration. Stalling, sudden shut-off, and resulting deceleration in automobiles is highly dangerous to drivers, passengers, and other vehicles on the road, especially when traveling at high speeds. This reported defect creates a clear risk for accidents, especially rear-end collisions, and could cause serious injury or death.

The National Highway Traffic Safety Administration (NHTSA) has been contacted about this issue and has been urged to start a formal investigation into the reported defect. Dozens of consumers have also complained to NHTSA about this issue. Fiat Chrysler has acknowledged that it is aware of the issue and complaints, but to date the automaker has not issued a recall and has done nothing to address this clear safety concern. When consumers have taken their 2017 Pacifica minivans to Chrysler dealerships after experiencing stalling or shut-off, Fiat Chrysler has been unable to identify the source of the issue and replicate the stalling and shut-off problem.

Chimicles & Tikellis LLP is interested in discussing this issue with owners and lessees of 2017 Chrysler Pacifica minivans. Fiat Chrysler’s sale of automobiles containing a dangerous defect and its failure to remedy this issue for consumers may constitute violations of state and federal consumer protection and other laws.
