Chimicles & Tikellis LLP has filed several class actions alleging that various title insurance companies overcharge their Pennsylvania customers for title insurance in connection with mortgage refinancings. In each of these cases, the Chimicles firm has either defeated defendant’s motions to dismiss or granted certification of a class. For example, in Alberton v. Commonwealth Land Title Company, No. 06-3755 (E.D. Pa.), the Court granted Plaintiff’s motion for class certification in a decision dated January 31, 2008. The Court certified all of the claims asserted in the Amended Complaint, including claims under Pennsylvania’s Unfair Trade Practice & Consumer Protection Law, and for fraudulent misrepresentation, which provide a potential recovery of treble and punitive damages. The firm is currently prosecuting a similar case against Old Republic National Title Company, and participated in the prosecution of similar claims against Stewart Title Guaranty Assurance Company. The Philadelphia Court of Common Pleas granted preliminary approval to a $ 4.9 million settlement in the Stewart Title case.
