Investigation Chimicles & Tikellis is investigating a proposed class action lawsuit on behalf of underwriters that process lender loan applications due to possible non-payment of overtime benefits. The Fair Labor Standard Act (“FLSA”) requires “covered” employers to compensate all nonexempt employees at a rate of not less than one and one-half times the regular rate of pay for work performed in excess of forty hours in a workweek. Some employers may be unlawfully classifying loan underwriters as exempt from overtime payments under federal law, despite the requirement that they be classified as nonexempt employees entitled to overtime.
