Chimicles & Tikellis, along with its co-counsel, has filed a proposed class action lawsuit on behalf of consumers in the United States District Court for the District of New Jersey against Funai Corporation, Inc. and Philips Electronics North America, Inc. (together, “Defendants”). The complaint alleges that the Defendants manufacture and sell Magnavox televisions which suffer from a defect that causes them to prematurely fail and become inoperable. According to the complaint, there are several consumer blogs and related websites where consumers from all over the country have complained about Magnavox televisions prematurely failing. When the Magnavox televisions abruptly stop working, there is no picture on the screen and no audio sound, according to the complaint.

The complaint asserts claims for a violation of the New Jersey Consumer Fraud Act, and also seeks relief for breach of express warranty and implied warranty, and for unjust enrichment. The proposed class consists of all consumers in the United States that have purchased an allegedly defective LCD and/or plasma Magnavox television.
