Gaiam Water Bottles
Chimicles & Tikellis, along with its co-counsel, has filed a lawsuit against Gaiam, Inc. (“Gaiam”) in the United States District Court for the District of Colorado. Gaiam sells a variety of products, including aluminum and stainless steel reusable water bottles. According to the complaint, Gaiam had, until recently, marketed its water bottles as being “BPA free.” BPA, which is short for bisphenol A, is a substance commonly used in plastic water bottles, and has been linked to potential health problems.
The complaint filed by C&T alleges that Gaiam recently inserted language into its marketing materials that revealed, for the first time, that its water bottles actually contained detectable levels of BPA. According to the complaint, Gaiam’s previous claims that the water bottles were BPA free were therefore false and misleading. The complaint asserts claims for violations of consumer protection laws, breach of contract, and unjust enrichment. It seeks class action status on behalf of consumers that purchased a Gaiam water bottle that was marketed as being BPA free.
